HMO Plans can never enforce pre-existing limita­tions. Meaning, you cannot be restricted in your benefits when you come onto a new plan and have any pre-existing condi­tions.  However, for PPO plans, you must have been previ­ously covered a minimum of 6 months with less than a 62 day gap between the termi­nation of your prior coverage and the effective date of the new coverage in order to avoid pre-existing limitations.

The Affordable Care Act (ACA) requires employers to provide all new hires and current employees with a written notice about ACA’s health insurance exchanges, effective March 1, 2013. On Jan. 24, 2013, the DOL announced that employers will not be held to the March 1 deadline. They will not have to comply until final regula­tions are issued and a final effective date is specified.
